Rhode Island Attorney General Peter F. Kilmartin found daily fantasy sports to be legal under State Law this week, Thursday.
Kilmartin's findings, derived from analysis and review's conducted by attorneys from both the civil and criminal divisions of the Office, were published and forwarded to Rhode Island Governor Gina Raimondo, Senate President M. Teresa Paiva Weed, and Speaker Nicholas Mattiello on Thursday.
Kilmartin, however, strongly advised law makers to establish and impose strict regulations on DFS operators to ensure problem gambling, age restriction and the prevention of the infiltration of a criminal element be addressed.
Perhaps most notable was Kilmartin's opinion that "while it is clear that daily fantasy sports, like most games, are a mixture of chance and skill", his office had applied the "dominant factor" which resulted in a determination that daily fantasy sports do not constitute a "game of chance."
"After a very thorough review of how these sites operate and an analysis of our statutes and relevant case law, I am confident that daily fantasy sports sites are currently legal in Rhode Island," Kilmartin wrote.
